Defending Claims in an Employment Tribunal
Sometimes an employer will be expecting a claim, but on occasions they will arrive without any warning and without any complaint to date from the employee.
It is important to assess the strength of a claim at the outset and to keep assessing it throughout once we have reviewed the documents and spoken to the witnesses. It is also important to advise clients on the hidden costs of Tribunal – management time being the biggest.
Our role is not to demonise our opponent or their client but to provide our clients with impartial advice on the strength of their claim, as early as possible and not to change our mind the closer we get to Tribunal.
We do not hand over cases to barristers at the last minute, we generally do our own advocacy to provide clients with consistency and confidence throughout.
